Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the Audiack audition-tracking application and website (the “Service”), provided by Audiack Ltd (“Audiack”, “we”, “us”, “our”). By creating an account, clicking “I agree,” or using the Service, you accept these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

1) Acceptance of Terms

Your use of the Service constitutes acceptance of these Terms and the Policies referenced above. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2) Eligibility & accounts

  • You must be 18 years or older (or the age of majority in your country).
  • Provide accurate, up-to-date information and safeguard your login details.
  • You are responsible for all activity under your account. Do not share your account or impersonate others.

3) Plans, billing & renewals

  • We may offer Free and Paid plans (monthly/yearly). Pricing and features are shown at checkout or on our site.
  • Payments are processed by Stripe (or similar). You authorise recurring charges, applicable taxes/VAT, and add-ons.
  • Subscriptions auto-renew unless you cancel before the renewal date in your account settings.
  • We’ll provide reasonable notice of price changes; new prices apply on your next billing cycle.
  • Unless required by law, fees are non-refundable. UK/EEA consumers may have a 14-day right to cancel digital services; if you request immediate access and we provide it, you may lose that right once service begins.

4) Fair & acceptable use

  • No unlawful, harmful, defamatory, infringing, or privacy-violating content.
  • No harassment, stalking, or doxxing; respect others’ rights.
  • No unauthorised access, probing, or interference with the Service or its infrastructure.
  • No scraping, bulk extraction, reverse-engineering, or circumventing rate limits/quotas.
  • No bots or automated account creation without written permission.

We may suspend or terminate accounts that breach this section.

5) Your content & licence to Audiack

  • You own the content you upload or create (auditions, notes, contacts, files, calendar data, income/expenses) (“User Content”).
  • You grant Audiack a worldwide, non-exclusive, royalty-free licence to host, process, display, and back up User Content solely to operate, maintain, and improve the Service.
  • You represent you have the rights and consents necessary to upload and use User Content in the Service.

6) Privacy & data protection

We process personal data in accordance with our Privacy Policy and applicable law (including UK GDPR). You remain responsible for obtaining any required consents to store third-party personal data (e.g., casting contacts) in the Service.

7) Third-party services

The Service may integrate with third-party tools (e.g., calendars, cloud storage, payments). Your use of those tools is governed by their terms and policies. Audiack is not responsible for third-party services.

8) Intellectual property

The Service, software, designs, and branding are protected by intellectual property laws. Except for rights expressly granted, Audiack retains all rights, title, and interest in the Service and its content.

9) Service changes & availability

We may modify, suspend, or discontinue features at any time. We strive for high availability but do not guarantee specific uptime or that the Service will be error-free.

10) Feedback

If you provide suggestions or feedback, you grant Audiack a perpetual, royalty-free licence to use them without obligation to you.

11) Suspension & termination

  • You can cancel your subscription at any time from your account settings.
  • We may suspend or terminate your access for breach, suspected fraud, abuse, or legal/regulatory reasons.
  • Upon termination, your right to access the Service ends; see “Data export & deletion”.

12) Data export & deletion

  • You may export certain data in-app (where available) or request an export via support.
  • After account closure, we delete or anonymise personal data within a reasonable period, except where retention is required by law or for legitimate business purposes (e.g., fraud prevention, tax records).

13) Warranties & disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, or non-infringement.

14) Limitation of liability

To the maximum extent permitted by law, Audiack and its personnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use. Our total liability for any claim arising out of or relating to the Service shall not exceed the amounts you paid to Audiack in the 12 months preceding the event giving rise to liability. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded by law.

15) Indemnity

You agree to defend, indemnify, and hold Audiack harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or breach of these Terms.

16) Consumer rights

If you are a consumer, you may have statutory rights that cannot be excluded. These Terms apply only to the extent permitted by law.

17) Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via the Service or email. Your continued use after the effective date constitutes acceptance of the updated Terms.

18) Governing law & jurisdiction

These Terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction, except where consumer laws in your country provide otherwise.

19) Complaints & disputes

Please contact support@audiack.com and we will try to resolve your concern promptly. If unresolved, you may have access to alternative dispute resolution as provided by law.
